Welcome to D. Rohde Home Services. By accessing our website, scheduling an estimate, or hiring us for plumbing, heating, or air conditioning services, you agree to be bound by the following Terms of Service (“Terms”). Please read them carefully.
1. Scope of Services
D. Rohde Home Services provides residential and commercial plumbing, HVAC, and drain cleaning services. All services are subject to these Terms, any written estimates provided, and the specific rules of your local municipality (e.g., Poughkeepsie, Kingston, etc.).
2. Estimates and Proposals
- Validity: Unless otherwise stated, written estimates are valid for 30 days.
- Unexpected Conditions: Estimates are based on visible conditions. If, upon starting work, we discover unforeseen issues (such as rotted pipes, illegal wiring, or hazardous materials), we will provide a revised estimate before proceeding.
- Permits: Unless explicitly stated in the proposal, the customer is responsible for any necessary municipal permits or HOA approvals.
3. Payments and Billing
- Payment Due Date: Payment is due in full upon completion of the service unless prior financing or billing arrangements have been made.
- Deposits: We may require a deposit for large projects or special-order equipment (e.g., specific HVAC units or water heaters).
- Late Fees: Past-due invoices may be subject to a late fee of 1.5% per month (or the maximum allowed by NY law).
- Collections: In the event of non-payment, the customer shall be responsible for all costs of collection, including reasonable attorney fees.
4. Appointments and Cancellations
- Access to Property: The customer must provide clear access to the workspace. An adult (18+) must be present to authorize work.
- Cancellations: Please provide at least 24 hours’ notice for cancellations. We reserve the right to charge a “Service Call Fee” for missed appointments or cancellations at the door.
- Arrival Windows: While we strive for punctuality, arrival windows are estimates. We are not liable for delays caused by traffic, weather, or emergencies at previous job sites.
5. Customer Responsibilities
- Hazardous Materials: Customers must disclose the presence of asbestos, lead paint, or other hazardous materials. We reserve the right to stop work if such materials are discovered.
- Personal Property: Please move any fragile items, furniture, or valuables away from the work area. D. Rohde Home Services is not responsible for damage to items left in the workspace.
6. Warranties and Limitations
- Labor Warranty: We provide a standard one-year warranty on labor for new installations. Minor repairs and drain cleaning are generally excluded from long-term warranties due to the nature of existing plumbing systems.
- Manufacturer Warranty: Equipment (boilers, AC units, pumps) is covered by the manufacturer’s warranty. We are not responsible for manufacturer defects.
- Limitation of Liability: To the maximum extent permitted by law, D. Rohde Home Services’ total liability for any claim shall not exceed the amount paid for the specific service provided. We are not liable for “consequential damages” such as lost wages or temporary housing.
7. Right to Refuse Service
We reserve the right to refuse service or terminate a project if:
- The work environment is unsafe or unsanitary.
- The customer is abusive or harassing toward our technicians.
- The requested work violates local building codes or safety standards.
8. Digital Communication
By providing your phone number and email, you consent to receive communications regarding your service, including:
- Booking confirmations and digital invoices.
- Technician tracking links and photos of the completed work.
- Periodic maintenance reminders.
9. Governing Law
These Terms are governed by the laws of the State of New York. Any disputes arising from these Terms or our services shall be resolved in the courts of Dutchess County, NY.
